The original-creditor advantage
“No action may be brought under the small claims procedure by any collection agency, collection agent, or assignee of a claim…”
12 O.S. §1751(B)
If you sell your uncollected debt notes then you may only end up with pennies on the dollar (if any). If you keep your uncollected debt notes and seek a Judgment as the original creditor, then the Tulsa County Small Claims Court is open to you, with all of the advantages - fast tracked Trials, no discovery or depositions. Retaining Mr. Ingham does not change your eligibility: the claim remains yours, it remains in your name. Mr. Ingham will serve as your attorney, not your assignee.
Venue: sue where the note was signed
Oklahoma Law gives creditors a venue election written for exactly your fact pattern: your Small Claims Case may be filed on in the county where the note was given, at the Plaintiff's option. Paper originated at your Tulsa office stays collectible at the Tulsa County Courthouse even if the borrower relocates outside of Tulsa County. No chasing borrowers county to county.
A workflow for recurring filers
Lender collection is a pipeline, not a case. The TSC Law Team will build it that way:
- Intake in batches — your default report becomes a queue of files with standardized evidence;
- The Affidavit — drafted and filed in waves;
- Service — managed against the clock with the Trial date in mind;
- Cases — moved forward with Judgment in mind.
Volume engagements are quoted as volume — see how fees work.
