The disputes involving individuals
- Personal loans to friends, family, exes, and roommates — the classic small claim;
- Deposits never returned — security deposits, deposits on services, down payments on promises that never materialized;
- Services paid for and never delivered — the contractor who took the deposit and vanished, the mechanic who made a malfunctioning vehicle worse, the vendor who no-showed the wedding;
- Property damage — the neighbor's tree removal that took out your fence, the borrowed truck returned with a bent frame;
- Private-party vehicle sales gone wrong — the check that bounced, the "clean title" that turned to be 'not so clean'.
Almost anything up to $10,000 fits under the umbrella of Oklahoma Small Claims Court. Above that, you can waive the excess and sue for $10,000 flat when speed matters more than the difference — a decision that is often worth making.
Small Claims can also be about property
Tulsa Small Claims Court is not only for money. Oklahoma Law authorizes replevin — an action to recover specific personal property worth up to $10,000 that someone is wrongfully keeping - The ex who kept the car that's titled to you, the "friend" storing your equipment indefinitely, the seller who took payment and kept the goods. Replevin is when the Judge orders the property itself returned, while a conversion claim allows you to request the dollar amount of the property be awarded to you. This can occur when the Defendant damages, sells, or will not return your property.
